Under the Medicare Secondary Payer Statute and Medicare regulation 42 CFR 411.26 et seq, Medicare is given the authority to require that its interests be considered in all workers' compensation cases expanding to include liability cases effective July 1, 2009. Failure of liability insurers to meet the stated requirements in a timely manner can result in civil penalties.
